NORMATEC PULSE 2.0 PANTS HIRE AGREEMENT AND TERMS OF SERVICE
- The hirer agrees to hire the pants from the Athlete Sanctuary in accordance with the terms set out in this Agreement.
- The rent, inclusive of GST, is due in advance of hire.
- • At the signing of this Agreement, the residual value of the pants is agreed to be $1499.95.
- The hirer has agreed to collect and return the Normatec Pulse pants in its carry case to 20 Cantala Drive, Jan Juc, Victoria on the date specified in this agreement.
- The Hirer will use the pants in a careful manner and will comply with all of the manufacturer’s requirements and recommendations.
- The Hirer agrees to use the pants for the purpose for which it was designed and not for any other purpose.
- The Hirer will be careful when using the zips and only inflate the boots when the zips are up fully.

- The Hirer will not alter, modify or attach anything to the pants.
- The Hirer will, at the Hirer’s own expense, keep the pants in good repair, appearance and condition.
- If the pants are not in good repair, appearance and condition when returned to the Athlete Sanctuary, the Hirer agrees to pay for any necessary repairs.
- The Normatec Pulse 2.0 pants will be in good working order, cleaned and good condition upon delivery.
- The Hirer will be responsible for risk of loss, theft, damage or destruction to the pants from any and every cause during the term of this hire agreement.
- In the event of total loss, irreparable damage or theft of the pants during the hire agreement or during transit, the Hirer will provide the Athlete Sanctuary with prompt written notice of such loss and will pay to the Athlete Sanctuary all unpaid rent for the term plus the full value of the Normatec Pulse 2.0 pants ($1499.95), at which point ownership of the pants passes to the Hirer.
- If the Hirer fails to return the pants to the Athlete Sanctuary at the end of the Term or any earlier termination of this Agreement, the Hirer will pay to the Athlete Sanctuary $50 per day for every additional day overdue from the end of the agreed hire term.
- The Hirer will indemnify and hold harmless the Athlete Sanctuary against any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities, including attorney’s fees and costs, arising out of or related to the Hirer’s use of the pants.
- The occurrence of any one or more of the following events will constitute an event of default (“Event of Default”) under this Agreement:
- The Hirer fails to pay any amount provided for in this Agreement when such amount is due or otherwise breaches the Hirer’s obligations under this Agreement.
- The Hirer becomes insolvent or makes an assignment of rights or property for the benefit of creditors or files for or has bankruptcy proceedings instituted against it under the bankruptcy law of Australia or another competent jurisdiction.
- On the occurrence of an Event of Default, the Athlete Sanctuary will be entitled to the entire amount of the Rent for the Term immediately due and payable without notice or demand to the Hirer and commence legal proceedings to recover the Rent and other obligations accrued before and after the Event of Default. The Athlete Sanctuary may take possession of the Normatec Pulse 2.0 pants, without demand or notice, without any court order or other process of law. The Hirer waives any and all damage occasioned by such taking of possession. The Athlete Sanctuary may terminate this Agreement immediately upon written notice to the Hirer.
- THE HIRER WILL NOT ASSIGN THIS AGREEMENT (SUB LEASE or SELL), THE NORMATEC PULSE 2.0 PANTS WITHOUT THE PRIOR WRITTEN CONSENT OF THE ATHLETE SANCTUARY.
- If the Hirer assigns this Agreement, the Hirer’s interest in this Agreement or the Hirer’s interest in the Normatec Pulse 2.0 pants without the prior written consent of the Athlete Sanctuary, the Athlete Sanctuary will be entitled to reimbursement for any damages caused by the assignment.
- Normatec Pulse 2.0 pants must be used only as instructed in the instruction booklet included.
- Hirer agrees to return all original items provided as part of the boots hire (including power conversion plug, power lead and Normatec carry case) provided.
- Hirer agrees to clean pants prior to return with a damp cloth and disinfectant (household).
- Hirer must agree to notify Athlete Sanctuary if they wish to extend the hire period 7 days prior to the end of the agreement. Maximum hire period of 2 months.
